Law on Permitting the Posting of Workers (Wet TTA).

The Dutch government has submitted a bill (Law on Permitting the Posting of Workers) that introduces a licensing system for temporary employment agencies. This proposal, which is currently before the House of Representatives for consideration, aims to go into effect Jan. 1, 2026. The system is designed to address abuses in the temporary employment industry, such as the exploitation of vulnerable workers by some temporary employment agencies, leading to unfair competition.

The new system requires staffing agencies to be officially authorized before they are allowed to dispatch workers in the Dutch market. This means they must meet strict conditions, including:

  1. Submitting a Certificate of Good Conduct (VOG) for legal entities.
  2. Depositing a financial deposit of â‚Ĵ100,000 per legal entity.
  3. Compliance with relevant labor, tax and social security laws, demonstrated by an inspection report.
  4. Providing a declaration of payment behavior, demonstrating that taxes and social security contributions have been paid.

Compliance with these conditions will be checked periodically by the Dutch Labor Inspectorate.

Preparing for the law on the admission of workers to the labour market

In preparation for the new legislation, it is essential that temporary employment agencies adapt in a timely manner. They are encouraged to apply for admission and obtain the NEN 4400-1 or NEN 4400-2 certificate, which is required for registration with the Stichting Normering Arbeid (SNA), before July 1, 2025. Certified companies before this date can take advantage of a transition period.
