3 tips to arrange your Brexit agreement-stay in the Netherlands

It will be no surprise for you that the United Kingdom (UK) has left the EU per December 31st, 2020. As a result, it’s not possible for UK citizens to work in the Netherlands anymore without a valid work-and residence permit. Under specific conditions, it’s possible to apply for a work- and residence permit according to the Brexit agreement. You will find 3 tips below to arrange this properly.

1 – Check whether the Brexit agreement conditions apply in your situation

Firstly, it’s of high importance to verify whether you are eligible for a residence permit according to the Withdrawal Agreement. There are 3 categories: temporary visa, permanent visa and a frontier worker visa. For a temporary visa, you should have lived in the Netherlands before January 1st 2021, but shorter than 5 years in total. The difference with a permanent visa is that you should have lived in the Netherlands for at least 5 years. In order to become eligible for the frontier worker visa, you should have worked in the Netherlands before January 1st 2021 as an employee or self-employed. The other conditions can be found on the website of the Immigration and Naturalisation Service (IND).

2 – Collect the necessary documents

Secondly, you will need to collect the necessary documents that need to be submitted along with the Brexit agreement application. For each category you need to submit at least a copy of your passport. In addition, the necessary documents depend on the type of visa and your specific situation (in example: being an employee or being self-employed).
Please be informed that per January 1st 2021 all documents from the UK need to be legalized with an apostille stamp, unless the documents are drawn up by the servants of the embassy or the consulate.

3 – Submit the application in time

Lastly, it’s important to submit the Brexit agreement application to the IND in time. Please be informed that the Brexit agreement application should be submitted before July 1st, 2021.
